Terms & Conditions
Common sense first.
We're a family outfit that does honest work for a fair price. We'd rather shake hands and get to it than bury you in fine print. But the world being what it is, here are the few pages of legal language that keep both of us protected. Be straight with us, we'll be straight with you, and odds are neither of us reads this page again.
1. General
By requesting an estimate or hiring Halliwell & Sons ("we," "us," "the company") for any service, you agree to these terms. We reserve the right to decline or stop work on any job. Services are arranged for property owners or their authorized representatives; if you hire us for a property, you confirm you have the authority to do so.
2. Estimates & Quotes
Walk-throughs and written estimates are free. An estimate reflects the scope discussed and visible at the time. Hidden conditions found once work begins (rot, water damage, code issues, concealed wiring or plumbing) may change the price; we will tell you before doing that additional work. Quotes are valid for 30 days unless stated otherwise.
3. Remodeling & Construction Work
Remodeling involves construction conditions: dust, noise, temporary loss of use of a room, and the discovery of pre-existing issues behind walls and floors. We take reasonable care to protect your home, but some disruption is normal. Material lead times and supplier delays are outside our control and are not grounds for a refund of work already performed.
4. Handyman & Repair Work
Repair and handyman work is performed to address the specific items requested. A repair to one part of an older system does not guarantee unrelated parts of that system. Where an item is beyond economical repair, we will say so rather than charge you to chase it.
5. Make-Ready & Rental Turns
Make-ready scopes are agreed in advance based on the unit's condition. Add-on items found during the turn are quoted and approved before they're performed. Completion photos are provided on request. Timelines assume reasonable access to the unit and timely approval of any add-ons.
6. Scheduling & Access
We schedule in good faith and communicate changes promptly. You agree to provide safe, reasonable access to the work area. Weather, supplier delays, and conditions beyond our control may shift a schedule. Pets should be secured during work hours for everyone's safety.
7. Payments
Payment terms are stated on your estimate. Larger projects may require a deposit and progress payments tied to milestones. Final payment is due on completion as defined in your estimate. Work performed is billable; once a service has been performed it is not subject to refund. Returned payments and past-due balances may incur fees and collection costs.
8. Change Orders
Changes to the agreed scope (added rooms, upgraded materials, new requests) are handled by change order with their own price and, where relevant, schedule impact. We do not perform out-of-scope work without your approval, and we do not expect you to pay for work you didn't approve.
9. Workmanship & Warranty
We stand behind our labor. If something we installed fails due to our workmanship within a reasonable period, we will correct it. This does not cover normal wear, misuse, alterations by others, owner-supplied materials, manufacturer defects (covered by the product's own warranty), or pre-existing conditions. Materials carry only the warranty offered by their manufacturer.
10. Limitation of Liability
Services are provided to a professional standard, but to the fullest extent allowed by law our total liability for any claim is limited to the amount you paid us for the specific service at issue. We are not liable for indirect, incidental, or consequential damages. Any claim must be raised within one year of the work. We are not responsible for delays or failures caused by events beyond our reasonable control.
11. Indemnification
You agree to indemnify and hold harmless Halliwell & Sons and its workers from claims, damages, and costs arising from your instructions, materials you supplied, conditions of the property not disclosed to us, or misuse of completed work.
12. Photos & Likeness
We may photograph completed work for our portfolio and marketing. These photos show the work, not identifying details of you or your home's interior contents. Let us know in writing if you'd prefer we not photograph your project and we'll honor it.
13. Dispute Resolution
If a concern comes up, talk to us first — most things get sorted with a phone call. Any dispute that can't be resolved that way will be settled by binding arbitration in Montgomery County, Texas, without a jury and not as part of a class action. Texas law governs these terms.
14. Privacy
We collect only what we need to quote and do your job and to reach you about it. We don't sell your information. We share it only with the people working on your project or as required by law. Photos you upload are used to prepare your estimate and perform the work.
15. Text Messaging
If you check the text-message box on our estimate form, or ask us to text you, you agree Halliwell & Sons may send you text messages about your estimate, appointments, job progress and invoices. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time and HELP for help. Consent is not a condition of hiring us. 16. Miscellaneous
These terms are the entire agreement between us regarding our services and may be updated from time to time. If any part is found unenforceable, the rest still applies. Failing to enforce a term once doesn't waive it later.
